These Terms & Conditions govern the use of the AB Pixel Studio website and the general terms applicable to our web design and development services. Project-specific terms, deliverables, timelines, and payment requirements will also be outlined in each client's signed project agreement.
By accessing this website, submitting an inquiry, or purchasing services from AB Pixel Studio, LLC, you agree to these Terms & Conditions and our Privacy Policy.
AB Pixel Studio provides web design and development services including:
The exact services included in each project will be described in the client's proposal and signed project agreement.
Before work begins, clients will receive a proposal outlining the agreed project scope, deliverables, pricing, and estimated timeline.
Project agreements are signed electronically through DocuSign or another approved electronic signature service.
Requests for additional pages, functionality, integrations, services, or other work outside the original scope may require an updated quote or additional agreement. Any additional costs will be communicated before out-of-scope work begins.
Initial project payments reserve time on our project schedule and allow work to begin. Because project work involves custom services and reserved production time, amounts already earned for completed work are generally non-refundable.
If a project is cancelled after work has begun, the client may be responsible for payment for work completed up to the cancellation date, as described in the signed project agreement.
Any project-specific cancellation or refund terms included in the signed agreement will control if they differ from these general website terms.
Clients are responsible for providing requested materials and information needed to complete the project. This may include:
Project timelines may be extended when required content, access, approvals, or client feedback are delayed.
Clients are responsible for ensuring that materials they provide may legally be used on their website.
Client-provided photographs, logos, written content, and other materials will be used whenever available and appropriate.
When suitable imagery is not provided, AB Pixel Studio may source stock photographs or other visual assets from reputable sources such as Unsplash or other appropriately licensed libraries.
Some premium stock imagery, fonts, plugins, software, or third-party assets may require additional licensing fees. Any required additional cost will be discussed before purchase.
Each website package includes the number of revision rounds described in the client's proposal or project agreement.
Clients should provide clear and consolidated feedback during each revision round. Requests beyond the included revisions or requests that substantially change the approved project scope may require additional fees.
Project timelines are estimates rather than guarantees unless otherwise stated in writing.
Completion dates may change due to client delays, scope changes, third-party services, technical issues, platform limitations, or other circumstances reasonably outside AB Pixel Studio's control.
Before launch, clients will have an opportunity to review their website and submit final feedback according to the revision terms of their project.
Once the website has been approved and all required payments have been received, AB Pixel Studio will prepare the website for launch, transfer, or final handoff.
Clients are not required to host their website through AB Pixel Studio unless otherwise agreed.
If a client chooses independent hosting, AB Pixel Studio will provide or transfer the completed website and applicable access necessary for the client to manage the site on their chosen platform or hosting provider.
The exact handoff process may vary depending on whether the website is built with WordPress, Wix, Squarespace, or another platform.
Clients who choose AB Pixel Studio hosting or maintenance services will receive the services described in their selected hosting or maintenance plan.
Whenever practical, domain names, Wix accounts, Squarespace accounts, payment processor accounts, and other business-critical services should remain registered in the client's name or business account.
Clients are responsible for recurring subscription fees charged directly by third-party providers unless their agreement specifically states otherwise.
Upon receipt of final payment, the client receives ownership or usage rights to the completed website and project deliverables as described in the applicable project agreement.
AB Pixel Studio retains ownership of its pre-existing tools, reusable code, development methods, internal systems, processes, and other materials not created exclusively for a particular client.
Third-party themes, plugins, fonts, photographs, software, and other licensed materials remain subject to the licenses of their respective owners.
Unless otherwise agreed in writing, AB Pixel Studio may display completed client work in its portfolio, website, social media, marketing materials, and other promotional materials.
Clients who require confidentiality or do not wish for their project to appear in our portfolio should discuss this before work begins.
Unless an ongoing maintenance plan has been purchased, responsibility for the website transfers to the client following final handoff.
AB Pixel Studio is not responsible for problems caused after handoff by client modifications, third-party developers, outdated software, unsupported plugins, hosting changes, compromised login credentials, platform updates, or third-party services outside our control.
Our services may use or integrate with third-party providers including, but not limited to, Stripe, DocuSign, Hostinger, WordPress, Wix, Squarespace, Google services, analytics providers, plugins, fonts, and other software platforms.
These services operate under their own terms, privacy policies, pricing, availability, and technical limitations. AB Pixel Studio does not control and cannot guarantee the continued operation or pricing of third-party services.
AB Pixel Studio designs and develops websites intended to support our clients' online presence. However, we do not guarantee specific levels of website traffic, search engine rankings, sales, revenue, leads, bookings, or other business results.
To the extent permitted by law, this website and our services are provided without guarantees that they will operate without interruption or be compatible with every future browser, device, plugin, platform, or third-party service.
To the maximum extent permitted by applicable law, AB Pixel Studio, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of this website or our services.
This includes losses resulting from third-party outages, platform changes, hosting interruptions, unauthorized access, client modifications, or services outside our reasonable control.
